**** This event is NOT a free event. Participants who have been accepted will receive an expungement at a reduced cost.
For purposes of this event, convictions of the following offenses are not eligible for expungements. You may still be eligible for an expungement, but you will have to contact a private attorney for advice and assistance.
WHAT CANNOT BE EXPUNGED AT A NEW DAY
1. Arrests and/or convictions not from Calcasieu Parish (in other words, no federal charges, no
charges from other parishes or other states)
2. Juvenile arrests and adjudications
3. Misdemeanor or Felony arrests or convictions that are
a. Sex offenses;
b. Crimes where the victim is a minor;
c. Domestic abuse battery;
d. Stalking; or
e. Crimes where the victim suffers serious bodily harm or death.
4. Convictions of Distribution of CDS (but a charge of Possession with Intent to Distribute can be
expunged)
5. Convictions for the commissions or attempted commission of crimes of violence - § 14:2
• Aggravated arson
• Aggravated crime against nature
• Aggravated criminal damage to property*
• Aggravated flight from an officer
• Assault (including)
o Aggravated assault
o Aggravated assault upon a dating partner
o Aggravated assault upon a peace officer
o Aggravated assault with a firearm
o Assault by drive-by shooting
o Domestic abuse aggravated assault
• Battery (including)
o Aggravated battery*
o Aggravated second degree battery
o Battery of a police officer
o Battery of emergency room personnel, emergency services personnel, or a healthcare professional.
o Second degree battery*
• Battery of a dating partner (including)
o By burning that results in serious bodily injury
o By strangulation
o By the intentional infliction of serious bodily injury
o By the intentional use of force or violence committed with a dangerous weapon
o By the intentional use of force or violence committed with a dangerous weapon and the offender
intentionally inflicts serious bodily injury
• Burglary (including)
o Aggravated burglary
o Simple burglary of an inhabited dwelling when a person is present in the dwelling, house,
apartment, or other structure.
• Carjacking
• Criminal abortion (including)
o Criminal abortion
o Aggravated abortion by dismemberment
• Disarming of a peace officer
• Distribution of Drugs (normally not expungeable but these are also considered crimes of
violence) (including)
o Distribution of fentanyl or carfentanil that is the direct cause of serious bodily injury
o Distribution of heroin that is the direct cause of serious bodily injury
• Domestic Abuse Battery (including)
o By burning that results in serious bodily injury
o By strangulation
o By the intentional infliction of serious bodily injury
o By the intentional use of force or violence committed with a dangerous weapon
o By the intentional use of force or violence committed with a dangerous weapon and the offender
intentionally inflicts serious bodily injury
• False imprisonment; offender armed with dangerous weapon
• Feticide (including)
o First degree feticide
o Second degree feticide
o Third degree feticide
• Home invasion
• Human trafficking
• Illegal Use of Weapons or Dangerous Instrumentalities*
• Intentional exposure to AIDS virus
• Kidnapping (including)
o Aggravated kidnapping of a child
o Aggravated kidnapping
o Second degree kidnapping
o Simple kidnapping
• Manslaughter
• Molestation of a juvenile or a person with a physical or mental disability
• Murder (including)
o Solicitation for murder
o First degree murder
o Second degree murder
• Possession of a firearm or carrying of a concealed weapon by a person convicted of certain
felonies
• Purse snatching*
• Rape (including)
o Aggravated or first degree rape
o Forcible or second degree rape
o Simple or third degree rape
• Robbery (including)
o Armed robbery
o Armed robbery; use of firearm; additional penalty
o First degree robbery

• Second degree cruelty to juveniles
• Sexual Battery (including)

o Sexual battery of persons with infirmities

• Trafficking of children for sexual purposes
• Vehicular homicide, when the operator's BAC exceeds .20
• Violation of a protective order if the violation involves a battery or any crime of violence
against the person for whose benefit the protective order is in effect.
The “starred” offenses may be eligible for an expungement if more than 10 years have passed since
completion of your most recent sentence, and you have no convictions of any kind and no pending
charges.
